Agreement to Terms

By accessing or using SwathIQ, the hail and storm mapping service operated by The Call Center Doctors ("Company," "we," "our," or "us") at swathiq.ccdocs.com (the "Service"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the Service.

The Service

SwathIQ provides hail and storm maps, storm history for places and addresses, storm alerts, reports, and property and contact data for roofing and property businesses. Some features require an account, and some are paid. We may add, change, or remove features at any time.

Accounts

You must be at least 18 years old and able to form a binding contract to use the Service. You agree to provide accurate information when you request access or create an account, and to keep it up to date. You are responsible for keeping your sign-in details confidential and for all activity under your account. We may approve or decline access requests, and we may suspend or close accounts at our discretion.

Weather Data Is an Estimate

Hail sizes, storm locations, and storm dates in the Service are estimates based on weather radar, public storm reports, and other weather data sources. They are not proof that any property was damaged, and they may contain errors. Always inspect a property before telling anyone it was damaged or filing a claim.

Use of Data

You may use data from the Service only for your own business and only in compliance with all applicable laws, including laws on telemarketing, do-not-call lists, text messages, email marketing, privacy, and door-to-door solicitation, as well as local ordinances. You are solely responsible for how you contact anyone using data from the Service. Before you call, text, or email anyone using data from the Service, you are responsible for checking the National Do Not Call Registry, applicable state do-not-call lists, and your own internal do-not-call list, and for obtaining any consent required by law. Data from the Service is licensed to you on a non-exclusive basis and may also be provided to other customers. You may not resell, redistribute, or publish data from the Service except as the Service allows or as we agree in writing.

Acceptable Use

You agree to use the Service only for lawful purposes. You may not:

• Use the Service in any way that violates applicable local, state, national, or international law
• Harass, threaten, or mislead property owners or anyone else
• Use the Service to support a false or exaggerated insurance claim
• Attempt to gain unauthorized access to any portion of the Service or its related systems
• Use any automated means, such as bots or scrapers, to access the Service without our written permission, except through public tools and APIs we publish and within their stated limits
• Copy, reverse engineer, or build a competing product from the Service
• Transmit any malicious code, viruses, or other harmful material
• Share your account with others or impersonate any person or entity

Purchases

Prices for paid features are shown before you buy. Payments are processed by Stripe. Refund terms, if any, are shown at the time of purchase. You are responsible for any taxes that apply to your purchase.

Intellectual Property

The Service and its content, including text, graphics, logos, maps, and software, are the property of The Call Center Doctors or its content suppliers and are protected by United States and international copyright, trademark, and other intellectual property laws. Map data is provided by OpenStreetMap contributors and other sources under their own licenses. Except as these terms allow, you may not reproduce, distribute, modify, or create derivative works from the Service without our prior written consent.

User Submissions

Any information you submit through the Service, including forms and uploaded files, may be used by us to provide the Service, respond to you, and communicate with you about our offerings. By submitting information, you represent that it is accurate and that you have the right to provide it.

Third-Party Links

The Service may contain links to third-party websites that are not owned or controlled by us. We are not responsible for the content, privacy policies, or practices of any third-party websites.

Disclaimer of Warranties

The Service and its content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We make no warranties regarding the accuracy, reliability, or completeness of any data or content in the Service.

Limitation of Liability

To the fullest extent permitted by applicable law, The Call Center Doctors and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, regardless of the theory of liability. Our total liability to you for any claim arising from your use of the Service shall not exceed the amount you paid us, if any, during the twelve (12) months preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless The Call Center Doctors and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the Service, your use of data from the Service, or your violation of these Terms of Use.

Termination

We reserve the right to terminate or suspend your access to the Service at any time, without notice, for any reason, including breach of these Terms of Use.

Service Agreements

If you have a separate written agreement with The Call Center Doctors, that agreement controls where it conflicts with these Terms of Use.

Entire Agreement

If any part of these Terms of Use is found unenforceable, the rest will remain in effect. These Terms of Use, together with our Privacy Policy and any separate written agreement with us, are the entire agreement between you and us about the Service.

Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any legal action or proceeding arising under these terms shall be brought exclusively in the state or federal courts located in Harris County, Texas.

Changes to These Terms

We may update these Terms of Use from time to time. Any changes will be posted on this page with an updated "Last updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised terms.
